Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and Three Fourteen, a company registered in France ("Three Fourteen", "we", "us"), governing your access to and use of the Skannr service available at skannr.app and skannr.io (the "Service").

By creating an account or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. Description of the Service

Skannr is an external attack surface monitoring platform that provides continuous port scanning, service detection, TLS certificate monitoring, differential analysis, and alerting for user-configured targets (IP addresses, domains, and CIDR ranges).

2. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding agreement. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3. Authorization to Scan

You must own or have explicit, documented authorization to scan any targets you add to Skannr. You are solely and fully responsible for ensuring you have the legal right to scan all IP addresses, domains, and network ranges you configure. Unauthorized scanning may constitute a criminal offense under applicable laws (including but not limited to the French Penal Code Art. 323-1 and the EU Directive on attacks against information systems 2013/40/EU).

Three Fourteen may request proof of authorization at any time and may suspend scanning pending verification.

4. Acceptable Use

You agree not to:

• Use Skannr to scan systems you do not own or are not authorized to scan.
• Conduct denial-of-service (DoS/DDoS) attacks or any form of network abuse.
• Attempt to exploit vulnerabilities discovered through scans on systems you do not own.
• Circumvent rate limits, access controls, or service restrictions.
• Use the Service for any unlawful purpose or in violation of any applicable law.
• Resell, redistribute, or sublicense access to the Service or scan results without prior written consent.
• Interfere with the Service's infrastructure, other users, or third-party systems.

5. Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately at security@skannr.app if you suspect unauthorized access. We strongly recommend enabling two-factor authentication (MFA).

6. Subscriptions and Billing

• The Service is offered under a freemium model with paid subscription tiers (Pro, Business, Enterprise).
• All subscriptions are billed on a recurring monthly basis. Prices are in EUR and may be subject to applicable VAT.
• Payment processing is handled by Stripe, Inc. You agree to Stripe's terms when providing payment information.
• You may cancel your subscription at any time from the dashboard or via the Stripe Customer Portal. Cancellation takes effect at the end of the current billing period — no prorated refunds for partial months.
• Upgrades take effect immediately. You will be charged a prorated amount for the remainder of the current billing period.
• Downgrades take effect at the end of the current billing period. You retain your current plan's features until then.
• If payment fails, we will retry automatically. After repeated failures, your account may be downgraded to the Free plan.
• Refunds are considered on a case-by-case basis. Contact billing@skannr.app.

7. Free Plan

The Free plan is provided at no cost with limited features (5 targets, daily scan frequency). Three Fourteen reserves the right to modify or discontinue the Free plan with 30 days' notice. Free plan accounts inactive for more than 6 months may be deleted.

8. Service Availability

We strive for high availability but do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify users of planned downtime.

9. Intellectual Property

The Skannr name, logo, software, and all related intellectual property are owned by Three Fourteen and protected by applicable copyright and trademark laws.

Your data remains yours. You retain all rights to the targets you configure and the scan results generated. We claim no ownership over your data. We use your data solely to provide and improve the Service as described in our Privacy Policy.

10. Account Suspension and Termination

We reserve the right to suspend or terminate accounts that:

• Violate these Terms or applicable law.
• Engage in scanning without authorization.
• Create risk for other users, third parties, or our infrastructure.
• Have been reported for abuse by target owners or network operators.

We will make reasonable efforts to notify you before or promptly after suspension, except in cases of severe or urgent abuse. Upon termination, your data will be retained for 30 days before permanent deletion (unless a longer period is required by law).

11. Limitation of Liability

To the maximum extent permitted by applicable law:

• The Service is provided "as is" and "as available" without warranties of any kind, express or implied.
• Three Fourteen's total aggregate liability for any claims arising from your use of the Service is limited to the subscription fees you have paid in the twelve (12) months preceding the claim.
• We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.
• We are not liable for any consequences arising from your use of scan results, including actions taken based on detected vulnerabilities.

12. Indemnification

You agree to indemnify and hold harmless Three Fourteen from any claims, damages, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your scanning of targets without proper authorization.

13. Modifications to the Terms

We may update these Terms from time to time. Material changes will be communicated via email and/or a prominent notice on the Service at least 30 days before taking effect. Your continued use of the Service after the effective date constitutes acceptance of the modified Terms.

14. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of France, without regard to conflict-of-law provisions. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts of France.

If you are a consumer residing in the EU, you retain the benefit of any mandatory consumer protection provisions of your country of residence, and you may bring proceedings in the courts of your country of residence.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
